FENCE RULES – MADEIRA (CITY), OHIO

Residential fences are permitted on private property within City of Madeira, subject to local regulations.

GOVERNANCE
The City of Madeira regulates residential fences through its municipal zoning and building ordinances. Section 150.049 assigns approval of new fences and walls to the City Manager and sets the City’s residential placement, height, visibility, orientation, material, maintenance, drainage, and inspection rules.
The City of Madeira Building & Zoning Department administers building permits, zoning review, and inspections. The Ohio Department of Commerce Building Department Lookup identifies the municipal government of Madeira as the agency enforcing residential one-, two-, and three-family construction.
Appeals from a City Manager fence or wall decision go to the Board of Zoning Appeals. Fence, wall, and hedge visibility clearance is determined by the City Manager using preferred templates periodically approved by the Planning Commission; the code does not publish fixed dimensions for those templates.
PERMIT AND APPROVAL REQUIREMENTS
• City Manager Approval: No person may construct or erect a new fence or wall without first obtaining approval from the City Manager. The code makes that approval discretionary and states that it may be withheld for any reason.
• Approval Exemptions: City Manager approval is not required for repairs to an existing fence, replacement of a fence when the original approval can be produced, invisible fences, or vegetative hedges. Invisible fences and vegetative hedges remain subject to any applicable requirements of the fence section.
• Building Permit: The City’s July 2026 permit handout requires a building permit when a fence is more than 6 feet high. The Residential Code of Ohio separately includes a building-code approval exemption for fences not over 6 feet high. This exemption does not remove Madeira’s separate City Manager approval requirement.
• Permit Fee and Zoning Review: The residential fee schedule lists a flat $100 fee for a fence when a building permit is required. The City’s permit handout states that zoning-code review is automatically included with a building-permit application.
• Inspection: The code authorizes the City to inspect a fence or wall, and the City’s inspection guidance lists a final fence inspection after the work is completed.
• Pool-Barrier Approval: A fence or wall required around a regulated private swimming pool requires a permit from the City Manager. Pools and their required enclosures are also subject to building permits under Chapter 152 and applicable Residential Code of Ohio requirements.
FENCE PLACEMENT RULES
• Lot Lines and Rights-of-Way: Fences, walls, supporting structures, and appurtenances must remain within the applicable lot lines and may not encroach onto adjoining lots or into public rights-of-way.
• Boundary and Easement Verification: The property owner, contractor, or agent is responsible for determining lot lines and confirming that the fence or wall follows the approved plans and does not encroach on another lot or an existing easement. A City approval, permit, or inspection does not establish the property boundary or relieve the owner of that responsibility.
• Connections to Adjoining Fences: A property owner may connect to a fence on an adjoining property only with written permission from the adjoining property owner.
• Visibility Clearance: All fences, walls, and hedges are subject to visibility clearance determined by the City Manager, based on preferred templates periodically approved by the Planning Commission. The code does not publish a fixed numeric sight triangle or driveway-clearance dimension.
• Utility Easements: Walls are prohibited within utility easements. A fence placed in a utility easement is subject to removal without notice by a utility company or the City when easement work is performed, and replacement is at the property owner’s expense.
• Drainage: Fences, walls, and hedges may not impede, inhibit, or obstruct culverts, drains, natural watercourses, or stormwater drainage.
• Adjacent Property: The code states that adjacent properties may not be materially affected by a fence or wall.
• Utility Safety: Ohio law requires notice through OHIO811 before excavation where Ohio’s underground utility protection law applies. For covered fence work involving digging, drilling, augering, boring, grading, or other excavation, notice must be given at least two working days, not including the day of notification, but not more than 16 calendar days before excavation begins. For an owner personally excavating at property containing one through four dwelling units or another property category covered by the statutory owner-excavator provision, the notice requirement does not apply unless excavation is planned in a utility easement, a public right-of-way, or an area where utility facilities are known to serve the property; an excavator employed by the owner must comply. OHIO811 is a notification center and does not mark lines itself; participating utilities or their locators mark covered facilities and provide positive-response information. This statewide utility-notice framework is separate from local fence permitting, zoning certificates, development approval, easement limits, right-of-way approvals, floodplain review, stormwater review, drainage review, road or county-engineer review, historic or design review, HOA restrictions, and other applicable requirements.
FENCE HEIGHT AND VISIBILITY RULES
• Front and Side Yards: Fences and walls in a front yard or side yard may not exceed 4 feet in height.
• Rear Yards: Fences and walls in a rear yard may not exceed 6 feet 6 inches in height.
• Retaining Walls: Retaining walls may be up to 6 feet in a front or side yard and up to 8 feet in a rear yard.
• Height Measurement: Fence or wall height is measured from the lowest point within 3 feet on either side of the fence to the topmost portion of the fence between posts.
• Posts and Decorative Features: Supporting posts and decorative features may exceed the permitted fence or wall height by up to 6 inches in a residence district.
• Land Contour: The code states that fencing and walls should follow the natural contour of the land.
• Visibility: The City does not publish a fixed numeric visibility limit in Section 150.049. Clearance is determined by the City Manager under the Planning Commission-approved template process.
• Pool-Barrier Height: A fence or wall required around a regulated private pool must be at least 42 inches and no more than 78 inches above grade.
MATERIAL AND CONSTRUCTION LIMITS
• Prohibited Materials: Residential fences may not be made from scrap materials, tires, canvas, cardboard, asphalt-style shingles, electrically charged fencing, corrugated metal, wire mesh, welded rolled wire, chicken wire, or sheet metal.
• Chain Link: Chain-link fencing must be vinyl coated and is permitted only in a rear yard.
• Sharp Materials: Barbed wire, razor wire, and other sharp-pointed fencing materials are prohibited.
• Picket Fences: Picket fences must have blunt points.
• Weather Resistance: Fence and wall materials must be weather resistant or treated to be weather resistant.
• Finished Side and Supports: The smooth finished side must face outward from the lot or yard being fenced, and supporting posts must face the interior of the property. If both sides are similarly finished, either side may face the adjoining property.
• Maintenance: Both sides of a fence or wall and the surrounding property, where reasonably accessible, must be maintained in equally good condition under City maintenance standards.
• Pool-Barrier Construction: A required private pool fence or wall must be located in reasonably close proximity to the pool and must be sufficiently rigid to prevent the passage of small children. A barrier up to 78 inches high may be solid when the pool is in the rear yard and the barrier does not extend forward of the rear line of the dwelling.
• Nonconforming Fences: If more than 50% of a nonconforming fence is removed or replaced, the entire nonconforming portion must be removed or replaced with fencing that complies with the current standards.
PRIVATE RESTRICTIONS
Private restrictions operate independently from City of Madeira fence rules.
HOA covenants, deed restrictions, subdivision restrictions, private easements, architectural-review covenants, recorded agreements, conservation easements, and other private property restrictions may impose stricter limits than the City’s zoning, building, drainage, utility-easement, pool-barrier, or right-of-way rules.
City Manager approval, a building permit, zoning review, or a City inspection does not determine private boundary rights, private easement rights, HOA approval, or compliance with private covenants.
REVIEW AND ENFORCEMENT CONTEXT
Fence issues are typically reviewed during permit or approval review when required, and through complaint-based code enforcement. Examples include:
• Approval and Permit Status: Construction or erection of a new fence or wall without City Manager approval, or construction of a fence more than 6 feet high without the required building permit.
• Approved Plans and Boundaries: A fence or wall that does not follow approved plans, remains outside the lot lines, encroaches onto another lot or a right-of-way, or conflicts with an existing easement.
• Height Limits: A fence or wall exceeding the 4-foot front- or side-yard limit or the 6-foot-6-inch rear-yard limit, including measurement and post-height requirements.
• Visibility: A fence, wall, or hedge that does not satisfy the clearance determined by the City Manager under the Planning Commission-approved visibility-template process.
• Materials and Orientation: Use of prohibited fence materials, non-vinyl-coated or improperly located chain link, sharp-pointed materials, or installation with the unfinished side or supporting posts facing outward.
• Utility Easements and Drainage: Walls within utility easements, fences affected by utility-easement work, or fences, walls, and hedges that obstruct culverts, drains, natural watercourses, or stormwater drainage.
• Maintenance and Replacement: Fences or walls not maintained in equally good condition on both sides, or replacement of more than 50% of a nonconforming fence without bringing the affected portion into compliance.
• Pool Barriers: A required pool fence or wall without City Manager approval, outside the 42-to-78-inch height range, or not meeting the published location and rigidity requirements.
• Utility Safety: Fence-post excavation or other covered digging that does not follow OHIO811 notice and positive-response procedures.
